According to factual allegations recited in a Memorandum Opinion issued by the Federal District Court for the Eastern District of Virginia, the Hanover County School Board passed a policy in Fall 2023 directing students to participate on athletic teams consistent with their biological sex rather than their gender or gender identity. In Spring 2024, the School Board prohibited a transgender girl from participating on the school’s girls’ tennis team pursuant to the School Board policy. On August 16, 2024, the Federal District Court blocked the School Board’s enforcement of the policy on the basis that the policy violated Title IX and the Equal Protection Clause. The Court specifically noted that School Board’s broad application of the policy against the student and its failure to consider the student’s specific circumstances justified the injunction.
