On Friday, November 12, 2021, a three-judge panel for the U.S. Court of Appeals for the Fifth Circuit enjoined enforcement of the federal Occupational Safety and Health Administration’s emergency temporary standard on workplace COVID-19 policies. OSHA’s COVID-19 rule, among other provisions, would have required employers with 100 or more employees to implement either (a) a mandatory COVID-19 vaccination policy, or (b) require weekly testing and face coverings. Permanent injunction of OSHA’s rule is still pending review; while pending, OSHA can take no further steps to implement or enforce the rule. Please click the link below for the full opinion.
