The Eleventh Circuit Court of Appeals recently issued a majority en banc decision that upholds the legality of separate school student bathrooms for biological males and females. Now, it seems that there is a “split” in the federal circuit courts on this issue, so it is possible the U.S. Supreme Court will get another chance to address this subject on the merits.
