DOL Issues New Opinion Letter on Organ Donation and FMLA

The U.S. Department of Labor has issued an opinion letter stating that organ-donation surgery can qualify as a "serious health condition" under the Family and Medical Leave Act of 1993.  FMLA guidelines have always included a "serious health condition" as a reason to qualify for unpaid, job-protected leave.  Previous interpretations of a "serious health condition" did not include leave for a covered employee who voluntarily chooses to undergo organ-donation surgery to benefit someone else.
